General
In this document “we”, “us”, “our”, “the seller”, ‘the company’ means Glass Carve Co., located at Ufferbacken 12, 07880 Liljendal, Finland, business-id 2991627-4. “The buyer” and/or “the customer” and/or “the client” refers to you or the person who accepts a quotation from us for the sale of goods and/or services or whose order for the goods and/or services is accepted by us.
The headings and sub-headings of these terms and conditions are for convenience only and do not form part of the contract.
Unless otherwise agreed in writing by us and except for terms and conditions implied by law (including consumers’ statutory rights), all quotations are made, and all orders are accepted subject to these terms and conditions.
Pricing
The price of any custom-made order varies due to several factors, such as the size of the item, glass specifications, design to be engraved, manufacturing stages and techniques, changes of material costs and consultation time required. Therefore, all prices are quoted for the individual jobs only and cannot be compared with pricing of any similar work done by us or other companies.
Where we have issued a quotation and not withdrawn it our quotation is open for acceptance within the period stated therein or when no period is stated, within 30 days only after its date.
We shall be entitled to a reasonable additional price in respect of any extra costs incurred by us if the goods supplied needs to be modified and further work arises as a result of the customer’s failure to supply the correct or complete information.
Value Added Tax (VAT) is charged at the Finnish standard rate (24%) on all items delivered to Finnish customers. Customers in the EU will only be exempt from VAT if a company VAT number and trading address is supplied. Sales outside the EU are exempt from VAT but import tax may be charged by the local customs office.
Acceptance of an order
Any order placed with us is subject to our acceptance even if paid for at that time and communication issued confirming receipt of your request. We rarely do decide to decline an order but if we do so we will inform you promptly and will issue a full refund.
You may communicate your acceptance of the order and the terms and conditions stipulated in this document by writing to us, either in paper or electronic form or you may communicate your acceptance to us verbally by telephone or in personal attendance with us. The order and the terms and conditions are considered to be accepted by the customer when a full deposit is paid to us as provided for in our quotation.
Payments and deposit
We accept payments by cash and bank transfer. For all custom-made orders we require a 50% deposit. This deposit is regarded as a confirmation of the order and no work on the item will be started before the deposit is fully paid. The deposit if refundable only if Glass Carve Co. is unable to manufacture the ordered item(s) for reasons not caused by the customer’s actions. The final balance will be due on collection of the item or prior to delivery.
The ownership of the goods will pass from Glass Carve Co. to the customer when full payments, including possible delivery costs, is made and received by Glass Carve Co..
Delivery
It is highly recommended that the finished work is collected by the customer directly from us, or the customer arranges the collection. Deliveries can be arranged by a third-party parcel service at client’s own risk. Transport and packing costs will be added to the final invoice.
For the delivery, we will package the glass carefully to minimise the risk of damage. Glass Carve Co. does not accept any responsibility for any damage that occurs during transit of the glass, including loading and unloading the goods by a third party or the customer. The customer must ensure that they have the facilities available for receiving the delivery.
Possible faults and the refund policy
The finished work must be inspected by the customer for any faults or damage and documentation signed indicating that the items are in good condition at the time of collection of the items. Any claims for faulty or damaged items must be made at the time of collection. When a fault in an item is confirmed by us, we will, and reserve the right to, either a) seek to correct it, b) manufacture a new item to replace the faulty item or c) offer a partial or a full refund to the customer.
The customer acknowledges that all glass items produced by Glass Carve Co. are hand-made and that it is characteristic for such items that no two pieces can be exactly alike and that variation and touch marks from tools occur occasionally and shall not be considered as faults. Furthermore, orders are often made against the design, such as a drawing, provided by the customer. The glass product made by us, based on this design will be an interpretation of that design in a different medium. Hence, this interpretation may lead to variation in the original design that, when in moderation, cannot be considered as a fault.
All our products are bespoke and therefore all sales are final. We do not accept any returns of goods and we do not issue any refunds, excluding the instances described earlier in this document.
Copyright
We accept any design, photograph or other artwork supplied by the client for a bespoke item, on the understanding that the client owns the copyright or has sought and had permission granted by the owner of the copyright of the supplied artwork.
We reserve the copy right for any designs or other artwork provided by us to a customer or as a glass item, unless otherwise agreed with the customer.
We reserve the right to photograph and video record all the products made by us, either in stages of making or as finished items, as well as, to publish these photographs and videos on our website and on other promotional materials and publications, unless otherwise agreed with the customer.
Installation and safety
Glass Carve Co. will offer advice to the customer regarding installation if needed, but we do not install finished work into its final location nor offer installation services. Glass Carve Co. will not be liable to the customer for any loss or damage caused by an improper installation, storage, maintenance or alteration of the goods by the customer.
All goods supplied by us are sold on the understanding that you will use them in accordance with relevant safety standards. Glass Carve Co. will not be liable to the customer for any loss or damage caused as a result at goods not being fit for any purpose, it being the customer’s express responsibility to verify this.
